DESCRIPTION:
- The current zoning is Residential Zone 1: Single Residential.
- Access to the Property will be from Fourth Street, Hermanus. The creation of this access as an extension of Fourth Street must be approved by the Principal Technologist: Civil Services - Hermanus of the Overstrand Municipality.
- The Property does not fall within the Environmental Management Overlay Zone. The access road to be established to the Property however falls within the Protected Area Buffer Based on the elevation profile, there is a 4 (FOUR) metre height difference between the boundary of Property and the outer boundary of Erf 2789 Hermanus. There is a channel and embankment starting from Erf 2789 Hermanus, the channel appears to cut across a small section of Erf 2788 Hermanus. It is proposed that a buffer area be created where no development should take place. The elevation profile and proposed buffer area can be seen on the locality maps.
INFRASTRUCTURE:
- The Property is un-serviced. Only the existing normal water, sewer and electricity services are available in the vicinity of the Property.
- All costs relating to the connections for water, sewer and electricity supply to the Property and any other services, if needed, including any required upgrades will be for the account of the purchaser.
- The purchaser will be responsible for all link and bulk services required to the Property.
- The purchaser will be responsible for all investigation levies and connection levies.
- The purchaser will be held liable for services availability fees on the Property and rates and taxes as from date of registration of the transfer of the Property in the Deeds Office.
GENERAL CONDITIONS:
- The Property is sold as it stands, "voetstoots", and the Municipality shall not be responsible for any defects in the Property whether patent or latent. The Property is moreover sold subject to all conditions and servitudes mentioned or referred to in the current title deed of the Property and to all such other conditions and servitudes which may exist in regard to the Property, including from any subdivision conditions, whether imposed by the local authority or any other person or body whomsoever. The Municipality shall not be required to point out the boundary beacons of the Property and shall not be liable for any deficiency in the extent of the Property which may be revealed on any survey or re-survey and shall not benefit by any excess.
- The purchaser will be responsible for all costs related to the transaction and development. This includes, but is not limited to, the Section 14 advertisement as required by Section 14 of Local Government: Municipal Finance Management Act (Act 56 of 2003) and attorney fees.
ADDITIONAL INFORMATION:
The encroachment that is currently on the Property will be disclosed to the purchaser and will be further addressed before the transfer of the Property to the purchaser.
