DESCRIPTION:

  • The current zoning is Industrial Zone 1:  General Industrial.  
  • Access to the Property will be from Industry Circle. The purchaser will only use the existing roads/access, and no new additional roads/accesses will be created without the written approval of the Principal Technologist: Civil – Hermanus of the Overstrand Municipality.
  • The applicable primary rights for Industrial Zone 1: General Industrial (see Annexure D) are as follows:
  • Industry,
  • Agricultural industry,
  • Builder’s yard,
  • Caretaker’s accommodation,
  • Factory shop,
  • Funeral parlour,
  • Heavy vehicle service station,
  • Industrial café (subject to the provision of Chapter 16.10)
  • Transport use,
  • Utility services; and
  • Warehouse and workshop.

 

INFRASTRUCTURE:

  • The existing water connection to the Property must be used to service the Property. The Property is un-serviced insofar electricity and the purchaser will be responsible for all costs pertaining to the establishment of an electricity connection. The upgrading/installation of the services for the purpose of the proposed development will be for the purchaser’s account.
  • The purchaser must provide the Property with and adequate sewer conservancy tank(s) which must comply with the standards of the Overstrand Municipality.
  • Bulk Infrastructure Contribution Levies are payable by the purchaser where there is an intensification of land use and a resultant increase in loading on the municipal engineering services. Bulk Contribution Levies will be charged according to the Overstrand Municipality’s Bulk Contribution Levy Policy and the prescribed tariffs as contained in Council’s budget. These tariffs are subject to annual adjustment. Levies will be payable prior to the submission of building plans (for sectional title units / commercial buildings), or rates clearance being issued (for free-standing properties).
  • The purchaser will be responsible for the construction and provision of all municipal services to the proposed development, including all connection fees, services deposits, and investigation levies for municipal services.
  • The purchaser must enter into a service level agreement with the Municipality before the commencement of any development on the Property.
  • The purchaser will be held liable for services availability fees on the Property and rates and taxes as from date of registration of the transfer in the Deeds Office.

 

GENERAL CONDITIONS:

  • The Property is sold as it stands, "voetstoots", and the Municipality shall not be responsible for any defects in the Property whether patent or latent. The Property is moreover sold subject to all conditions and servitudes mentioned or referred to in the current title deed of the Property and to all such other conditions and servitudes which may exist in regard to the Property, including from any subdivision conditions, whether imposed by the local authority or any other person or body whomsoever. The Municipality shall not be required to point out the boundary beacons of the Property and shall not be liable for any deficiency in the extent of the Property which may be revealed on any survey or re-survey and shall not benefit by any excess.
  • The purchaser will be responsible for all costs related to the transaction and development. This includes, but is not limited to, the Section 14 advertisement as required by Section 14 of Local Government: Municipal Finance Management Act (Act 56 of 2003) and attorney fees.
